SEC SHORTENED VALIDITY OF PAYMENT ASSESSMENT FORMS

In line with the efforts of the Securities and Exchange Commission (SEC) to expedite the processing of transactions with the Commission, the public is hereby informed that the validity of the Payment Assessment Form (PAF) has been shortened to 10 calendar days from 45 calendar days. The 10-day validity will apply to PAFs for all SEC transactions, except those issued for the payment of fines and penalties, starting Monday, July 28, 2025. PAFs issued prior to the said date will remain valid for a period of 45 days from the date of issuance. The public is advised to settle their PAFs within the 10-day period to ensure the speedy processing of their applications.

RMC No. 79-2025- Providing Extension of Deadline for Filing of Tax Returns and Payment of VAT due of Nonresident Digital Service Provider pursuant to Republic Act of No. 12023
Pursuant to Section 14 of Revenue Regulations No. 3-2025, as amended by Revenue Regulations No. 14-2025, and in view of the recent launching of the VAT on Digital Services (VDS) Portal, this Circular is issued in exercise of the authority of the Commissioner to further extend the deadlines during the transition period provided under these Regulations for Nonresident Digital Service Providers (NRDSPs) to file their Value-Added Tax (VAT) returns and remit the corresponding VAT due. Accordingly, the deadline for filing of VAT returns and payment of VAT due for the second (2nd) quarter of 2025 by NRDSPs, originally set for July 25, 2025 and previously extended to July 31, 2025 pursuant to Revenue Memorandum Circular No. 75-2025, is hereby further extended to August 5, 2025 (Tuesday).

BIR holds Public Consultation on Capital Markets Efficiency Promotions Act (RA No. 12214)

In a move to boost the country’s investment landscape, the Bureau of Internal Revenue (BIR), under the leadership of Commissioner Romeo D. Lumagui, Jr., conducted a Public Consultation on Republic Act (RA) No. 12214, or the Capital Markets Efficiency Promotion Act (CMEPA), on June 23, 2025 at the BIR National Office in Quezon City. The event gathered tax professionals, financial market participants, legal experts, and representatives from both public and private sectors to discuss the major tax reforms introduced by RA No. 12214. Signed into law by President Ferdinand R. Marcos, Jr. on May 29, 2025, the CMEPA is a landmark legislation designed to streamline the taxation of passive income, encourage foreign capital inflow, and foster a more efficient and competitive Philippine capital market. Deputy Commissioner Marissa O. Cabreros of the Operations Group formally opened the public consultation with her Opening Remarks, setting the tone for the discussions on the proposed Revenue Regulations to implement the law

Digital tax platform Taxumo reported that low-income earners remain the primary users of its online tax services—a trend the company views as a sign of growing access to the formal economy and increasing tax compliance among the poor. In its “State of Online Taxation 2025” report, Taxumo said the poor accounted for the biggest share of online income tax taxpayers in 2025 at 30 percent based on transactions processed on its platform. These are people with per capita income of less than P13,873—the official poverty threshold set by the Philippine Statistics Authority.

Tobacco provinces get P21 billion tax share

The Department of Budget and Management (DBM) has approved the release of the excise tax share to the tobacco-producing provinces, amounting to P21 billion. In line with revenue-sharing laws, the DBM has authorized the release of funds to the Bureau of the Treasury, based on the latest Special Allotment Release Order (SARO) list issued on Monday. The funds represent the share of local government units from the 2023 collections of excise taxes on Virginia-type, Burley and native tobacco products. Under Republic Act 7171, the financial support from the national government for beneficiary provinces shall be sourced from 15 percent of excise taxes on locally manufactured Virginia-type cigarettes and distributed pro rata based on Virginia tobacco production volume.

BIR confident of hitting tax collection target

Bureau of Internal Revenue Commissioner Romeo Lumagui Jr. is confident of hitting the P3.2 trillion tax collection target for the year. That’s amid the many projects announced by President Marcos during his State of the Nation Address. Following the SONA, Lumagui said they can collect the needed taxes to fund projects mentioned by the president. This year’s target is higher than last year’s P2.8 trillion collected tax.

BIR online payments now at 90%, eyes real-time tax transactions

The Bureau of Internal Revenue (BIR) is accelerating its digital transformation through key modernization programs aimed at streamlining taxpayer services and enhancing transparency, as the agency builds on its strong collection performance in the first half of the year. “Approximately around 90 percent of the payments are now online,” BIR Commissioner Romeo Lumagui Jr. said in news release on Tuesday. “We’ve been ramping up all these e-services so that people will not have to go to our offices and go to the banks or all those things… you can do it online.”

DOF launches GOCC Caravan

DTI seeks higher funding to support MSMEs

The Department of Trade and Industry (DTI) will request additional funding from the government to expand its financing program to provide more support for micro, small, and medium enterprises (MSMEs). DTI Secretary Cristina Roque said the agency is looking for higher funding for the loan programs of the agency’s financing arm, Small Business (SB) Corp. This year, SB Corp. has allocated ₱10 billion for its loan program aimed at strengthening MSMEs, which comprise 99 percent of the country’s business establishments. “We can go higher because the President mentioned that there’s really a push for the puhunan (capital). So, definitely, he can give more funding,” Roque said on the sidelines of Post-SONA Discussions on Tuesday, July 29.

Makati councilors to oppose Real Property Tax hike — Arenas

Makati City Councilor Martin Arenas said on Tuesday, July 29, that the councilors from the majority bloc of the Makati City Council will oppose any attempt by Mayor Nancy Binay to increase Real Property Taxes (RPT) in the city. Arenas made the statement following Binay’s alleged unannounced arrival during a councilors’ meeting on July 27, held in preparation for the inaugural session of the City Council. According to him, the mayor began asking questions about the ordinance that reduced the RPT during the term of former Mayor Abby Binay, particularly regarding the impact of the 20 percent tax reduction enacted last year on barangay.

SC: Gov’t share in Malampaya includes contractor’s income taxes

The Supreme Court has ruled that the Philippine government’s share in the profits from the Malampaya Natural Gas Project includes the income taxes of its private contractors. In its 19-page decision made public Wednesday, the SC En Banc lifted the charges against Shell Exploration B.V., PNOC Exploration Corporation, and Chevron Malampaya LLC for unpaid income taxes. The ruling also lifted the “notice of charge” and cleared two Department of Energy (DOE) officials, Compliance Division chief Thelma Cerdeña and Financial Services officer-in-charge Nora Tuazon. “The Court is on all fours with COA (Commission on Audit) to zealously ensure that the government is never placed at a disadvantage and that it rightfully receives what is due it in all its transactions. Nevertheless, remaining bound by the Constitution and the laws of the land, the Government cannot be allowed to renege on its obligation, especially when such has been distinctly outlined in the contract it freely entered into and agreed to,” the court said.

SC lifts charges vs Shell, PNOC, Chevron over Malampaya income taxes

The Supreme Court reversed a Commission on Audit finding that Malampaya Natural Gas Project contractors were liable for more than P53 billion in income taxes for searching and obtaining petroleum from 2002 to 2009. In the decision of the en banc promulgated on July 30, 2025, the court granted the petitions for certiorari filed by Shell Philippines Exploration B.V., Chevron Malampaya LLC and PNOC Exploration Corporation. The contractors challenged the COA decision which found P53.14 billion in income taxes had been deducted from the government’s share and that the contractors were the ones liable for the taxes. The Supreme Court reiterated in its decision that Presidential Decrees No. 87 (Oil Exploration and Development Act), No. 1206 (Act Creating the Department of Energy) and No. 1459 (Authorizing the Secretary of Energy to Enter Into and Conclude Service Contracts) clearly and unambiguously state that the government’s share includes all taxes.

BIR, Landbank to create VAT portal for foreign digital services providers

The Bureau of Internal Revenue (BIR) has partnered with Land Bank of the Philippines to develop a portal for digital services providers located outside the Philippines to help them conveniently file and pay their value-added tax (VAT) obligations. BIR Commissioner Romeo Lumagui Jr. and LandBank president and CEO Lynette Ortiz formalized the partnership through a memorandum of agreement signed on July 8. The collaboration is in line with Republic Act No. 12023, which mandates the imposition of VAT on foreign digital service providers like Netflix, Amazon, Disney, Google and Alphabet for services consumed within the country.

Supreme Court: GIS not sufficient proof of shareholding

THE SUPREME COURT (SC) ruled that inclusion in a corporation’s general information sheet (GIS) is not sufficient proof of shareholding, noting that the stock and transfer book is the official and primary record for determining a corporation’s shareholders. “It is established in jurisprudence that the mere inclusion as [a] shareholder in the GIS of a corporation is by itself insufficient proof that such [a] person is a shareholder,” the 17-page ruling penned by Justice Ramon Paul L. Hernando read. “Between the stock and transfer book and the GIS, the former is controlling.” The ruling, promulgated on April 21 but released only on Thursday, also emphasized that stock ownership must be proven through a stock certificate issued in the individual’s name.
