NO MANUAL FILING OF AITRs in all Large Taxpayers Services (LTS) offices, Revenue District Offices (RDOs), nor in the eFiling/TAC at the BIR NTC – Auditorium
EXCEPT FOR: Senior Citizens (SC) or Persons with Disabilities (PWDs) filing their own returns; employees deriving purely compensation income with two or more employers (concurrently or successively) during the taxable year; employees whose spouse is not entitled to substituted filing; and employees qualified for substituted filing but opted to file for AITR for purposes of promotion, loans, scholarships, foreign travel requirements, etc.
Taxpayers who have electronically filed and/or paid their AITR, including its attachments NEED NOT SUBMIT THE PRINTED COPY OF THE ELECTRONICALLY FILED RETURN to the concerned LTS office or RDO for stamping.
Bank Bulletin No. 2024-1 reminds all Authorized Agent Banks to accept tax returns/payments of internal revenue taxes on April 6 and April 13, 2024 and to extend their banking hours up to 5:00 P.M. for the period April 1-15, 2024.
All sellers/merchants engaged in sale of goods and services in electronic marketplaces are reminded to register their business and submit a Sworn Declaration (Annex A of Revenue Memorandum Circular No. 8-2024) with the BIR RDO having jurisdiction over their place of business on or before April 15, 2024, as prescribed under the said Circular.

Manual filing of attachments, EXCEPT Certificates of Withholding Tax (BIR Form Nos. 2307, 2316, etc.), shall be allowed in BIR offices/Tax Assistance Center (TAC). The submission of copies of BIR Form Nos. 2307 and 2316 shall be done following the procedures prescribed under Revenue Regulations (RR) No. 16-2021.

BIR surpasses collection target as February 2024 Collection grew by more than 24%
For the first two months of 2024, the Bureau of Internal Revenue (BIR), under the leadership of Commissioner Romeo D. Lumagui, Jr., was able to surpass its collection target of ₱ 445.535 Billion and increase its collection by more than 24%.
Lumagui: BIR raids large-scale illicit cigarette traders in 3 warehouses/factories in Cavite with P5.4 billion tax liability
Bureau of Internal Revenue Commissioner Romeo D. Lumagui Jr. reported the success of a large-scale BIR raid in 3 warehouses/factories in Indang and Dasmariñas, Cavite last March 21, 2024. The total tax liability computed after the raid reached an estimate of P 5.4 Billion, making the operation one of the largest BIR raids against illicit cigarettes.
Traders divert imported fish to evade VAT

MANILA, Philippines — Unscrupulous fish importers are diverting frozen stocks of round scad (galunggong), bonito (tulingan) and mackerel (alumahan) to the wet markets to evade paying value added tax (VAT), the Department of Agriculture (DA) said yesterday. Agriculture Secretary Francisco Tiu Laurel Jr. said that some “crafty” importers sold some of their frozen imported fish inventory to the wet markets, where the sale of marine products is exempt from VAT.

The effect of new assessment in the Final Decision on Disputed Assessment

In tax assessment, the Bureau of Internal Revenue (BIR) and the taxpayers will likewise protect and defend their duties and rights based on laws, rules and regulations, and jurisprudence. The BIR must ensure that taxpayers are declaring and paying the correct amount of taxes based on their valid examination of the books of account and collect payment, upon notice and demand, of any deficiency due to the government. Whereas the taxpayers need to exhaust all administrative remedies to challenge any alleged tax deficiency before seeking relief from the courts. Filing a protest to a Formal Letter of Demand (FLD) and Final Assessment Notice (FAN), which may either be a request for reconsideration or a request for reinvestigation, is among the administrative remedies available to taxpayers. The assessment then becomes a disputed assessment, and the Commissioner of Internal Revenue (CIR) or a duly authorized representative has a duty to resolve and decide on the disputed assessment. This decision is known as the “Final Decision on Disputed Assessment (FDDA).”

Most-favored nation clause: Tax credit limitation clarified

The Philippines has about 44 bilateral tax agreements to eliminate or mitigate double taxation of cross-border transactions involving certain types of income (e.g., service fees, dividends, interest, royalties). In eliminating double taxation, the 2017 Organisation for Economic Co-operation and Development (OECD) Commentaries on the Model Tax Convention on Income and on Capital provide two leading principles — the principle of exemption and the principle of credit. One of the oldest tax treaties we have is with the US, which grants US residents the lowest Philippine tax rate that may be imposed on a resident of a third State or what we call the “most-favored nation (MFN)” clause for royalty income. Further, the US allows a credit against the US tax equivalent to the taxes paid or accrued in the Philippines, provided that the tax credit does not exceed the limitations set by US law for the taxable year.

Sandiganbayan upholds ruling on case of former BIR officer

A former Bureau of Internal Revenue officer accused of extorting P610,000 and 10-hectare farmland from a local businessman has failed anew to convince the Sandiganbayan to have his corruption case dismissed. In a six-page resolution promulgated on 3 April, the anti-graft court Third Division denied BIR-Davao Region revenue officer Leo Gonzales’ motion for reconsideration due to lack of merit.

Bulacan ask SC to reconsider October ruling on Angat dam water tax

MANILA The Bulacan provincial government on Thursday filed an appeal before the Supreme Court asking the tribunal to take a second look at its earlier ruling that precluded water from the Angat Dam as a natural resource subject to taxes, including a share for the province. “We most humbly and respectfully move for the reconsideration of the Decision of the Honorable Court en banc dated 03 October 2023 which ruled that appropriated dam water is not to be considered national wealth, and therefore, not subject to the national wealth tax,” Bulacan Gov. Daniel Fernando said in a statement after filing the motion for reconsideration.

No extension: Tax filings to lift BIR collections to P406 billion in April

MANILA, Philippines The Bureau of Internal Revenue (BIR) is expecting to collect more than P400 billion this month, largely driven by the annual income tax return (ITR) filing which will not be extended beyond April 15. BIR Commissioner Romeo Lumagui said the deadline of filing and payment of the ITRs, which summarizes a taxpayer’s transactions last year, is still on April 15. “Our tax campaign started early in February. So that should be enough time for our taxpayers to be reminded of the tax filing on April 15,” Lumagui told The STAR.

Tax break for 2-wheeled EVs pushed

MANILA, Philippines — It is high time to bring the “green” to Philippine roads by expanding current tax breaks to include two-wheeled electric vehicles (EVs), a leading think tank said. “We commend the government’s issuance of Executive Order 12, which gives tariff incentives to importers of electric vehicles, but these have been limited to three- and four-wheeled units which only affluent Filipinos can afford,” said Dindo Manhit, president of The Stratbase Institute.
