Lumagui: BIR raids Laguna warehouse with 100,000+ bottles of Flava vape
Bureau of Internal Revenue Commissioner Romeo D. Lumagui Jr. reported that a raid of a warehouse located in San Pablo City, Laguna resulted into the confiscation of 1,029 master boxes (102,900 bottles) of vape products and the arrest of two individuals. The raid was made in coordination with the Philippine National Police Criminal Investigation and Detection Group, Laguna Provincial Field Unit. The total deficiency taxes computed by the BIR for the San Pablo raid is Php 75,745,323.19.

BIR holds Public Consultation on the Draft Revenue Regulations to implement the EOPT Act

The two-day consultation commenced with the Commissioner’s Opening Message wherein he called the event “not just a consultation, but an opportunity to gather and discuss the EOPT Act with the taxpaying public.”

Lumagui: BIR dismissal of employee for POS-CRM tampering supported by DOF, together with another batch of BIR dismissals
Bureau of Internal Revenue Commissioner Romeo D. Lumagui Jr. welcomes the support of the Department of Finance (DOF) in upholding the integrity and professionalism of BIR employees. The support of the DOF was manifested in its confirmation of several dismissals made by the BIR for erring BIR personnel. The cases vary from Grave Misconduct, Conduct Prejudicial to the Best Interest of the Service, Violation of Republic Act 3019 or the Anti-Graft and Corrupt Practices Act, and Violation of Reasonable Office Rules and Regulations. The DOF also confirmed the dismissal of an erring BIR personnel tagged in tampering and altering the Point of Sales-Cash Register Machine (POS-CRM).

Internal Consultation on EOPT draft Revenue Regulations held
With the passage into law of Republic Act No. 11976 or Ease of Paying Taxes (EOPT) Act, the EOPT Oversight Committee, headed by ACIR Larry M. Barcelo of the Legal Service, conducted a 2-day internal consultation on the draft Revenue Regulations to implement the law on February 14 and 15 at the National Training Center Auditorium, BIR Compound, Diliman, Quezon City. Almost 1,000 revenuers, comprised of Assistant Commissioners, Head Revenue Executive Assistants, Revenue District Officers, Division Chiefs from the National Office and Regional Offices, Section Chiefs from Client Support Section and Collection Section and other concerned personnel, attended the consultation (face-to-face and via Zoom)

EoPT Act: Insights on the draft Implementing Rules and Regulations

They say good things come in threes. In April 2021, I wrote an article for this section, “Wish list for reforms on tax filing, payment, and administrative compliance.” In that article, I listed three wishes, some of which were addressed by the Ease of Paying Taxes (EoPT) Act, which was then a bill. My wishes and the general taxpayer’s wishes then are to enhance the portability of tax transactions by removing restrictions on the filing and payment of taxes, institutionalizing the acceptance of e-signatures on all tax returns and documents required by the BIR, and removing the distinction between the value-added tax (VAT) sales invoice and VAT official receipts. Less than three years from then, those wishes came true in the form of the EoPT Act, or Republic Act No. 11976, which was signed into law on Jan. 5 and published in the Official Gazette on Jan. 7. Taxpayers and the tax community indeed welcomed the new year 2024 right. The EoPT Act includes the following amendatory provisions: Out-of-district filing and payment of taxes; One VAT base and invoice for the sale of goods and services; and Digitalization, electronic filing, and acceptance of certain BIR applications. To effectively implement the above provisions and other provisions of the EoPT Act, the law authorizes the Secretary of Finance, after consultation with the Bureau of Internal Revenue (BIR) and the private sector, to promulgate the necessary rules and regulations within 90 calendar days from the effectivity of the EoPT Act.

Senate bill meant to boost cities realty taxes passed on 3rd reading

THE PHILIPPINE Senate on Monday approved on third and final reading a priority bill seeking to fast-track and boost the monitoring of real property sales of local government units (LGUs) and to maintain a digital database of up-to-date market values. In a 23-0-0 vote, senators voted in favor of Senate Bill No. 2386 or the Real Property Valuation and Assessment Reform Act, which aims to improve real property tax collections by updating valuations without increasing or imposing new taxes.

Refund remedies of EOPT

The Ease of Paying Taxes Law (EOPT) has introduced changes in claims for excess input VAT and erroneously paid taxes. The period that the BIR is mandated to act on these claims is now defined. The law is also clear on the remedies available to taxpayers in case a claim for refund is denied. But when you read the draft revenue regulations (RR) on refunds, it appears that the BIR wants to introduce additional remedies that are not provided for by law. I am afraid that this signals another vicious cycle of false hopes and dismissed judicial appeals.

Philippine Chamber of Commerce and Industry (PCCI) urges livestock, transport inclusion in carbon tax review

THE Philippine Chamber of Commerce and Industry (PCCI) said any review of a proposed carbon tax should include the livestock farming and transport industries, which it described as major emitters of greenhouse gases. “Both sectors are major contributors to greenhouse gas emissions and the bill needs to clarify how the policy will be equally and fairly applied to the aforementioned industries,” the PCCI said in a position paper from earlier in the month.

BIR rules out deduction for stores honoring senior, PWD discounts

THE Bureau of Internal Revenue (BIR) said retailers who plan to honor the expanded discounts planned for senior citizens and persons with disabilities (PWDs) have no legal basis at the moment to claim tax deductions. Speaking at a consultation organized by the Department of Trade and Industry (DTI) this week, Ron Mikhail Uy, representing the BIR, said: “We cannot give additional (tax deductions) without basis in the law. As of now, that is the stand of BIR.”

Digital nomad visas: Redefining the workation

Following an announcement made in May, the Bureau of Immigration (BI) is set to launch its new digital nomad visa program in 2024. Digital nomad visas give individuals the right to live and work remotely outside their home country. With such a visa, individuals will be allowed to reside in a foreign country while being employed elsewhere. Currently, over 50 countries offer similar remote work visas to attract remote workers and freelancers. While not all countries have specific visas tailored for remote workers, some offer options that can accommodate them. Thailand, for instance, has the Thailand Elite Visa for extended stays, which is not explicitly designed for digital nomads. Indonesia’s Social Budaya Visa is geared towards cultural or educational purposes, while Malaysia’s MM2H Program is for long-term stays. Taiwan’s Gold Card Visa targets skilled professionals but can facilitate remote work arrangements. The Working Holiday Visa of Japan and the H-1 Visa of South Korea may be utilized by remote workers under certain conditions. While the landscape for digital nomad visas in Asia is still evolving, these options reflect a growing recognition of the needs of remote workers in the region.

Electric vehicle stakeholders still awaiting talks on tax breaks

MANILA, Philippines – Key personalities from the electric vehicle (EV) industry have expressed concern as the waiting game continues for the National Economic Development Authority (NEDA) to hold talks on an executive order concerning tax breaks on certain EV types. This developed despite the announcement by NEDA chief Arsenio Balisacan that the Tariff Commission (TC) would be asked to conduct public hearings to carefully consider the views of all stakeholders on Executive Order No. 12. The EO’s provisions is expected to be reviewed one year after its implementation on February 20, 2023.

DOF engages finance sector to further refine proposed bill on simplifying passive income tax and other financial instruments

The Department of Finance (DOF) engaged finance sector stakeholders in a briefing on March 1, 2024 on the proposed Package 4 of the Comprehensive Tax Reform Program (CTRP) that will simplify the tax structure on passive income and certain instruments and other financial products. A priority measure of the Marcos, Jr. administration, Package 4 of the CTRP is aimed at making the taxation of passive income, financial intermediaries, and financial transactions simpler, fairer, and globally competitive. The proposal will ensure a more efficient Philippine tax system, boost the competitiveness of the country’s capital markets, and foster greater financial inclusion among Filipinos.

BIR raids vape seller with P75.7-M tax deficiency

BIR ordered to refund Petron P67.9M in erroneously paid excise taxes

The Bureau of Internal Revenue (BIR) has been ordered by the Court of Tax Appeals to refund or issue a tax credit certificate to Petron Corporation in the amount of P67.99 million representing erroneously paid excise taxes for importing alkylate, a gasoline blending product, in 2017. The importations were imposed an excise tax of P67,991,825 under the National Internal Revenue Code “on the ground that alkylate is supposedly a product of distillation similar to naptha.”
