Lumagui: BIR “fixer” syndicate arrested, millions extorted from taxpayer
Bureau of Internal Revenue Commissioner Romeo D. Lumagui Jr. warns the taxpaying public to avoid dealing with unscrupulous individuals that act as “fixers” for their tax obligations. This is in relation to a syndicate that was caught on April 12, 2024, extorting millions of pesos from a taxpayer with the promise of “fixing” their tax issues. The syndicate, all private citizens and not employees of the BIR, extorted 3.6 million pesos from the taxpayer, using their alleged connection with high-ranking BIR officials. The syndicate even used the forged signatures of the BIR Commissioner, the Deputy Commissioner for Operations Group, the Deputy Commissioner of the Legal Group, the Assistant Commissioner of the Large Taxpayer Service, and a Revenue District Officer. “The arrest of this syndicate of fixers serves as a reminder to all taxpayers to avoid dealing with these groups and to always verify the authority of any person in dealing with your tax obligations. We urge the public to report to the BIR these individuals/groups. We will help you entrap and arrest them,” Commissioner Lumagui stated.

Operations Group conducts 1st Staff Conference
The Operations Group (OG), under the leadership of Deputy Commissioner (DCIR) Maridur Rosario, conducted its 1st Staff Conference on March 19, 2024 at the 3/F Executive Conference Room in the BIR National Office. DCIR Rosario delivered the Opening Remarks where she emphasized the “OG on the GO” service philosophy, which entails ensuring that all OG Programs and Projects are aligned. “By conducting a Staff Conference, all officials under the Operations Group would be aware of the status of each OG Program and Project and how they complement one another. Areas of collaboration can also be identified,” said DCIR Rosario.

Recto receives World Bank President’s full support on digitalizing PH tax system, expects a tram from the Bank to work with DOF in building digital infra needed

Recto has received full support from World Bank Group (WBG) President Ajay Banga on his key priority to fully digitalize the country’s tax system, with the Bank set to assemble a dedicated team to conduct workshop and assist the Department of Finance (DOF) in enhancing its digital infrastructure to improve tax payment and collection efficiency. During the high-level meeting on April 17, 2024, President Banga expressed willingness to assist the Philippines in its digitalization initiatives to boost revenue generation, underscoring its importance in fixing leakages.

Refund of excess input VAT clarified

It is a well-settled doctrine that tax refunds are in the nature of tax exemptions and, hence, are construed strictissimi juris against the taxpayer. A claim for a tax refund is a statutory privilege; thus, the rules and procedures for claiming a tax refund should be faithfully complied with by the taxpayer. However, due to the reforms of the tax system (TRAIN Law, CREATE Law, EoPT Act), changes in the processes and rules for the application for tax credits and refunds caused confusion as to the proper procedure and timelines in the value-added tax (VAT)-refund process. Thankfully, the Bureau of Internal Revenue (BIR) issued Revenue Regulations (RR) No. 5-2024 clarifying the rules on tax refunds, which covers claims that are filed starting July 1, 2024 onwards, to give ample time for the tax-payers and the BIR to adjust to the new requirements and procedures prescribed.

Recto position PH at the forefront of crisis and disaster response as first country to sign a Rapid Response with World Bank

Finance Secretary Ralph G. Recto has positioned the Philippines at the forefront of crisis and disaster response by being the first country to sign the Rapid Response Option (RRO) agreement with the World Bank Group (WBG). The RRO is part of the WBG’s Expanded Crisis Preparedness and Response Toolkit, which empowers client countries to deploy resources from their existing Bank portfolio more effectively to deliver a swift response when crises occur. Specifically, it allows countries in the event of an emergency to immediately access up to 10% of undisbursed and uncommitted balances in their portfolio with the International Bank for Reconstruction and Development (IBRD) or International Development Association (IDA) for response actions. The flexible resource reallocation will provide the Philippine government with immediate liquidity to rapidly deliver critical services—such as healthcare, shelter, and food—in times of emergency.

BIR warns against tax ‘fixers’

THE BUREAU of Internal Revenue (BIR) put out a warning to the public on Tuesday against unscrupulous individuals acting as “fixers” and promising to settle an individual’s or company’s tax issues. Commissioner Romeo B. Lumagui, Jr. issued the warning in a statement announcing the arrest of fixers earlier this month and their being charged with extortion. “The arrest of this syndicate of fixers serves as a reminder to all taxpayers to avoid dealing with these groups and to always verify the authority of any person in dealing with your tax obligations,” said Mr. Lumagui.

New taxpayer classifications under the Ease of Paying Taxes Law

2024 ushered in a new tax law, the Ease of Paying Taxes or EoPT Law, or Republic Act No. 11976, which introduced a number of reforms, one of which was to classify taxpayers based on their gross sales. The EoPT Law became effective on Jan. 22, and the Bureau of Internal Revenue (BIR) recently issued the implementing guidelines for classifying taxpayers under Section 21(b) of the National Internal Revenue Code (Tax Code). Revenue Regulations (RR) No. 8-2024 will take effect on April 27, or 15 days from its publication on the BIR website on April 12.

Recto completes his team with newly appointed Chief Economist and Undersecretaries for fiscal policy formulation and revenue operations

Finance Secretary Ralph G. Recto has completed his team at the Department of Finance (DOF) with President Ferdinand R. Marcos, Jr.’s newly appointed Chief Economist and two Undersecretaries tasked to lead fiscal policy formulation and revenue operations. “I thank the President for appointing such highly competent officials. They are all valuable additions to my team at the DOF. I am confident that they will lead their respective offices with great skill, dedication, and integrity,” he said. Atty. Charlito Martin R. Mendoza takes on the role of Undersecretary for the Revenue Operations Group (ROG). Mendoza will oversee the operations of the Bureau of Internal Revenue (BIR) and the Bureau of Customs (BOC), which do the heavy lifting to ensure that the government meets its annual revenue collection targets.

CTA denies Zuellig Pharma’s plea for P59.8M tax refund

The Court of Tax Appeals (CTA) has denied the petition of Zuellig Pharma Asia Pacific Ltd. Phils. ROHQ which sought a P59.8 million tax credit or refund from the Bureau of Internal Revenue (BIR). Zuellig Pharma wanted the P59,809,336.79 refunded or credited as it reportedly represented its excess and unutilized input value added tax (VAT) on domestic purchases of goods and services attributable to its zero-rated sales for 2011.

DTI confiscates vape products worth P31M

DEPARTMENT of Trade and Industry (DTI) said that it confiscated P31 million worth of vape products from last February 9 to April 23 for violating the Vape Law, or Republic Act (RA) No. 11900. In a statement, the DTI said that it has monitored 84,523 physical and online vape establishments during the period, which led to the confiscation of 65,865 vape units.

BIR official not ambush target – police –

The police official, who spoke on condition that he is not named, said the assailants’ target was the BIR officer’s driver, 29-year-old Arvin Lacuesta.
